Terms of Service

1. Acceptance of Terms

By accessing or using WearPass.club ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. WearPass reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. How WearPass Works

WearPass is a consumer-to-consumer (C2C) managed marketplace that facilitates wardrobe rentals and resale of designer ethnic garments between individual users. WearPass does not own inventory. We act as a trusted intermediary facilitating transactions, logistics, and dispute resolution.

3. User Accounts

You must create an account to list garments or rent wardrobes. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years of age to use the Platform. Each person may maintain only one active account.

4. Renter Terms

• Renters pay a rental fee to access a garment for a 5-day period
• A pre-authorized security hold is placed on the renter's payment method — this is NOT a charge
• Garments must be returned in the same condition as received, within the agreed return window
• Only minor reversible adjustments are permitted (temporary hooks, drawstring adjustments, draping pins). Cutting, permanent stitching, or structural modifications are strictly prohibited
• Condition photos should be taken upon receipt (the app prompts you) — they are your evidence if a damage claim is later raised. Photos are required to reject a delivery, and any issues must be reported within the 3-day confirmation window
• Failure to return a garment results in full capture of the security hold

5. Wardrobe Owner Terms

• Owners must list only garments they rightfully own
• All photos must accurately represent the garment's current condition
• All measurements must be precise and measured in inches as per our guidelines
• Listings are subject to approval by the WearPass team within 24 hours
• Owners receive the majority of rental fees and sale prices, with exact rates shown during listing
• Payouts are processed within 48 hours of confirmed return
• Condition photos must be taken before shipping (4 angles, prompted by the app)

6. Prohibited Activities

• Listing counterfeit, stolen, or borrowed garments
• Providing false measurements or misleading photos
• Altering, damaging, or modifying rented garments
• Circumventing the Platform to transact directly with other users
• Creating multiple accounts to manipulate ratings or bookings
• Using the Platform for any illegal purpose

7. Security Holds & Payments

WearPass uses PCI-DSS compliant payment processing partners (Razorpay, Cashfree) for payment processing. Security holds are pre-authorizations on the renter's payment method. The hold amount stays in the renter's bank account and is only captured in cases of damage, unauthorized alterations, or non-return. All payments are processed in Indian Rupees (INR).

8. Shipping & Returns

Shipping is facilitated through Shiprocket. Prepaid shipping labels are provided for both outbound and return shipments. Renters must pack garments per our guidelines and schedule a return pickup within the agreed window. WearPass is not liable for delays caused by courier services.

9. Damage & Disputes

In case of damage, prohibited alterations, or condition discrepancies, WearPass reviews condition photos from both parties and makes a determination. Minor reversible damage may result in partial security hold capture; major damage, structural alterations, or irreversible modifications result in full hold capture paid to the owner. WearPass's decision on disputes is final. Both parties are encouraged to communicate through the platform to resolve concerns amicably.

10. Limitation of Liability

WearPass is a marketplace facilitator and does not guarantee the quality, fit, or condition of garments listed by owners. Our liability is limited to the transaction fees we collect. We are not responsible for personal injury, allergic reactions, or any indirect damages arising from use of garments accessed through the Platform.
